Terms and Conditions, Vesta London
Article 1, Definitions
In these terms, the following definitions apply:
- Cooling-off period: the period during which the consumer can exercise their right to withdraw from the contract.
- Consumer: a natural person not acting for purposes related to a trade, business, craft or profession, who enters into a distance contract with the seller.
- Day: calendar day.
- Continuing performance contract: a distance contract for a series of products and/or services where delivery and/or purchase obligations are spread over time.
- Durable medium: any means that allows the consumer or seller to store information in a way that allows future reference and unmodified reproduction.
- Right of withdrawal: the consumer's option to withdraw from the distance contract within the legal cooling-off period.
- Seller: the natural or legal person offering products and/or services to consumers at a distance.
- Distance contract: a contract concluded as part of a system organised by the seller for the distance sale of products and/or services, using exclusively means of distance communication up to and including the conclusion of the contract.
- Means of distance communication: any means used to conclude a contract without the consumer and seller being in the same place at the same time.
- Terms and Conditions: the present terms applicable to the seller's sales.
Article 2, Scope
These Terms and Conditions apply to every offer and every distance contract concluded between the seller (Vesta London, registered in the Netherlands) and the consumer.
Before the contract is concluded, the text of these Terms is made available to the consumer. If the contract is concluded electronically, the consumer can save these Terms on a durable medium.
If there's a contradiction between these general Terms and any product-specific conditions, the provision most favourable to the consumer applies. If any provision of these Terms is held to be invalid, the rest remains in force, and the invalid provision is replaced by one that best reflects the original intent.
Article 3, Offers
Offers are non-binding and may be amended. Each offer contains a complete and accurate description of the products or services. Images are indicative, small variations in colour or shape may occur.
Each offer specifies:
- the price, exclusive of any customs duties or import VAT (which may be the buyer's responsibility);
- any delivery costs;
- how the contract is concluded;
- the existence of the right of withdrawal;
- payment, delivery and execution arrangements;
- the period for which the offer is valid;
- the languages in which the contract may be concluded;
- any codes of conduct followed by the seller.
Article 4, Formation of the contract
The contract is formed when the consumer accepts the offer and meets any conditions set. The seller will confirm receipt of the acceptance electronically without delay. Electronic data is securely stored by the seller.
The seller may, within legal limits, check the consumer's ability to pay and refuse a contract for valid reasons.
With the order, the consumer receives:
- the address for any complaints;
- information on how to exercise the right of withdrawal;
- information on warranty and after-sales service;
- the essential terms of the contract;
- cancellation terms if the contract has a duration of more than one year. The contract is subject to product availability.
Article 5, Right of withdrawal
The consumer has a 14-day cooling-off period to withdraw from the contract without giving any reason, starting the day after they receive the product.
During this period, the consumer must handle the product with reasonable care. To exercise this right, the consumer must notify the seller in writing or by email and return the product in its original condition and packaging.
Return shipping costs are the consumer's responsibility unless stated otherwise. If the right of withdrawal isn't exercised within the period, the contract is considered accepted.
Article 6, Costs in case of withdrawal
The seller will refund all payments received within 14 days of withdrawal, after receiving the returned product or proof of return.
Article 7, Exceptions to the right of withdrawal
The right of withdrawal does not apply to: personalised products, perishable goods, items sealed for hygiene reasons that have been opened, products that can't be returned for health or hygiene reasons, and digital content downloaded after the consumer's express consent.
Article 8, Price
Prices are those shown at the time of the offer and include all applicable taxes. Prices may change for legal or financial reasons (such as exchange rates or raw material costs). Typographical errors are not binding on the seller.
